WHO WE ARE

MoBuzy is a content monetization platform created and operated by ‘Echosense Technologies Private Limited’, a company incorporated under the laws of India. The term Echosense includes ‘Echosense Technologies Private Limited’s subsidiary/ies, affiliate/s, channel/s, joint venture/s, sister concern/s, franchise/s et cetera. Echosense operates the content monetization platform MoBuzy (hereinafter referred to as “MoBuzy”, “Platform”, “we”, “us” or “our”), to deliver content to the end users (hereinafter referred to as “End Users”, “you” or “your”) of mobile app developers (hereinafter referred to as “Publishers”) and to drive traffic to the websites of website owners who provide their content to the Platform (hereinafter referred to as “Content Providers”) from time to time. These services to Publishers and Content Providers are provided in lieu of a share of the advertising revenue from the advertisements served to End Users within the content (hereinafter collectively referred to as “Services”).

MoBuzy values the privacy of the End Users as they enjoy the content served via our platform and the visitors of www.mobuzy.com (hereinafter referred to as “MoBuzy website”). This document (“Privacy policy”) informs you of what information do we collect and our practices regarding the information that we collect from End Users and/or from visitors of the MoBuzy website (hereinafter referred to as “Visitors”).

The use of the MoBuzy website or consumption of content provided by the Platform through Publisher apps may involve the collection and use of behavioral and browsing data Information to improve our services and to give End Users and Visitors a better experience. We request you to kindly read this Privacy Policy carefully, so that you understand why certain information is collected and how is it used.

By using the MoBuzy website or consuming content provided by the Platform through Publisher apps, you agree that we may collect, use and share your behavioural data and other information available on your device in accordance with this Privacy Policy, as revised from time to time. SCOPE AND APPLICATION OF THIS PRIVACY POLICY

This Privacy Policy applies to MoBuzy platform and/or MoBuzy Website with respect to usage of the Platform or MoBuzy Website and includes any services associated with MoBuzy that incorporate this Privacy Policy by reference. Such MoBuzy – related services may have further privacy-related terms that you must agree to as part of your use of such services.

Please note that the scope of this policy is limited to End Users and Visitors and not with any other product or services offered by Echosense. This scope of this policy doesn’t cover the Content Providers and therefore it is not applicable to Content Providers.

Please also note that this Privacy Policy does not apply to Information collected:
(i) by any third party (including any third-party websites, apps, plugins or mobile app SDKs) that you may access through our publisher mobile app, content partner websites or MoBuzy website; or
(ii) by other companies and organisations who advertise their services on MoBuzy platform or MoBuzy website.

CHANGES TO THIS PRIVACY POLICY

MoBuzy reserves the right to revise or add specific instructions, from time to time, policies and terms to this Privacy Policy. These instructions, policies and terms form part of this Privacy Policy. Where we consider that any changes to this Privacy Policy are reasonably material, we will notify you via the MoBuzy website, prior to the change becoming effective.

By continuing to consume content provided by MoBuzy platform or using MoBuzy Website after any changes to this Privacy Policy, with or without notice from us, you are agreeing to the revised Privacy Policy.

THE INFORMATION WE COLLECT AND HOW WE COLLECT IT

In providing services through MoBuzy, we collect, store and use the following Information relating to End Users:

We collect information about your internet connection, the equipment you use to access our Services and your usage details.

We collect this information directly from you when you provide it to us, especially when you log-in through other social media website login interface, for the purposes of accessing articles which require adult age consent; and/or automatically through your usage of our Services (information collected automatically may include usage details, preferences, IP addresses, android id and device model, your marketing preferences and information collected through cookies, location and other tracking technologies).

Please note that we do not collect any data when you browse a Content Partners’ website and your interactions, including personal data, comments, etc on Content Partners’ websites are governed by their privacy policies.

We collect the following information relating to Visitors of MoBuzy Website:

Your Personal Information – the information or a combination of information that can be associated with a specific person and could be used to identify that specific person whether from that data, or from the data and other information that we have, or is likely to have access to. We do not consider personal information to include information that has been made anonymous or aggregated so that it can no longer be used to identify a specific person, whether in combination with other information or otherwise.

Information provided by you in registration/inquiry forms that may include usage details, preferences, IP addresses and other information entered by you. We also collect the data shown in the comments form, and also the Visitor’s IP address and browser user agent string to help spam detection.

HOW WE USE THE INFORMATION WE COLLECT

We may use your Information for any of the following purposes:

to provide MoBuzy services (and the features within the platform or MoBuzy website) to your account, for example, we gather information about the sections and links that the End Users click. However, this is purely for the purpose of providing better experience to the End Users.
to better understand how End Users access and use MoBuzy services, in order for us to improve our services and respond to customer desires and preferences, including for us to provide language and location customisation, personalised help and instructions;
to help us develop our new services and improve our existing services;
to assess the effectiveness of and improve advertising and other marketing and promotional activities on or in connection with MoBuzy.

SHARING OF INFORMATION WE COLLECT

By agreeing to this Privacy Policy, you consent to the third party use, sharing and transfer of your Personal Information as described in this section.

Sharing for the provision of MoBuzy services

We and our affiliate companies may share your non-personal Information within our group of companies and with joint venture partners and third-party service providers, contractors and agents, in each case, for the following purposes:

providing MoBuzy services to you;
assisting us in carrying out the purposes set out under the “HOW WE USE THE INFORMATION WE COLLECT” section above;
carrying out our obligations and enforcing our rights under this Privacy Policy; and/or
helping us understand and improve MoBuzy platform and/or MoBuzy Website.

Sharing for marketing purposes

We allow third party marketing partners (such as other analytics providers and advertising partners) to collect your Information over time and by using device information and services when you use MoBuzy services.
If you interact with social media features on our Services, such as the Facebook Like button, or use your social media credentials to log-in or post content, these features may collect information about your use of the Services, as well as post information about your activities on the social media service. Your interactions with social media companies are governed by their privacy policies.
As we continue to develop our business, we or our affiliate companies may be acquired by a third party or may re-organise our group structure. In these circumstances, your Information may be transferred within our group and/or to a third party who will continue to operate the Platform and MoBuzy Website or similar services under either this Privacy Policy or a different privacy policy which will be notified to you. The party to which your Information is transferred may be located, and use your Information, outside of your jurisdiction.

Sharing for Legal purposes

We may share your information when we believe in good faith that such sharing is reasonably necessary in order to investigate, prevent, or take action regarding possible illegal activities or to comply with legal process. We may also share your information to investigate and address threats or potential threats to the physical safety of any person, to investigate and address violations of this Privacy Policy or to investigate and address violations of the rights of third parties and/or to protect the rights, property and safety of MoBuzy, our employees, End Users, or the public. This may involve the sharing of your information with law enforcement, government agencies, courts, and/or other organizations on account of legal request such as subpoena, court order or government demand to comply with the law.

COMMUNICATIONS FROM US

We communicate with you via notice display within the MoBuzy Website when we consider it necessary to do so.

Service-related announcements

We may from time to time send you service-related announcements via notice display within the MoBuzy website or via email to Publishers and Content Partner when we consider it necessary to do so (such as when we temporarily suspend the MoBuzy Platform or MoBuzy Website for maintenance). You may not opt-out of these service-related announcements, which are not promotional in nature.

Third party services on MoBuzy

MoBuzy may link End Users and Visitors to social media or other features or services (including websites, plug-ins and widgets) provided by a third party. For example:

We may (whether in advertisements or otherwise within content served via our platform) provide you with links or features that allow you to access third party services or websites (or access within Publisher App or content provider website content that is hosted on those third-party services or websites). For example, you may be able to access videos hosted by a third party within the content served via our Platform.

These third-party services may be hosted by the relevant third party or us. Your use of any such third-party services (whether social media services or otherwise), including any Personal Information you provide to such third parties and their collection and use of your Personal Information, are subject to the relevant third party’s own terms of services and privacy policies and not this Privacy Policy, so please review those third-party terms carefully. This Privacy Policy only applies to any information collected by us, does not apply to any services offered by or information practices of any third parties, and we bear no liability for any third-party use of any Information provided by you to them.

PERIOD OF USE OF YOUR PERSONAL INFORMATION

When Visitors leave a comment or a response on a form, such content and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For Visitors that register on the MoBuzy website, we also store the personal information they provide in their user profile. All Visitors can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Other than the above-mentioned cases, we will generally retain your Personal Information for only so long as is necessary to fulfill the purposes for which it was collected, as set out under the “How We Use Your Information” section above.

However, it is important to note that MoBuzy cannot exercise any control on the duration of retaining the Personal Information collected by third parties, including the Publishers and Content Providers, during the use of MoBuzy services by you.

WHAT RIGHTS YOU HAVE OVER YOUR DATA

Visitors of the MoBuzy Website, who just visited the website or left comments, can request to receive an exported file of the personal data we hold about them, including any data they have provided to us. They can also request that we erase any personal data we hold about them. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

If you are an End User and you have visited a Content Provider’s website then your privacy and data are governed by the privacy policy and data policy of the Content Provider’s website. If you want access or rights to edit any data related to your visit, comments or any other information held by the Content Provider website about you, then you must approach the Content Provider as this data is not held by MoBuzy and such rights are prerogative of the Content Provider.

HOW WE PROTECT YOUR DATA

Please note that appropriate physical, electronic and managerial procedures, in compliance with accepted industry standards, have been implemented to safeguard and help prevent unauthorized access to your information and to maintain data security. These safeguards are subjected to the sensitivity of the information that is collected, processed and stored and the current state of technology.

We assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control. You play an important role in keeping your personal information secure. You should not share your personal information with anyone. If we receive instructions using your personal information, we will reckon that the instructions have been authorized by you.
